1. التعريفات

• المنصة: تطبيق وموقع ترافوجو (travogo.app) المملوك لـ طاقم ترافوجو.
• المسافر: كل مستخدم يتصفح المنصة أو ينشئ حسابًا لطلب عروض أسعار.
• الوكالة: منشأة سياحية مرخّصة تم قبول انضمامها إلى المنصة.
• طلب عرض السعر: طلب يقدمه المسافر عبر المنصة لتلقي عروض من الوكالات.
• عرض السعر: عرض تقدمه الوكالة استجابةً لطلب المسافر.
• الطلب المباشر: طلب يقدمه المسافر لباقة محددة تعرضها وكالة بعينها، ويوافق فيه صراحةً على كشف بيانات تواصله لتلك الوكالة لتتواصل معه.

2. طبيعة المنصة — وسيط فقط

• ترافوجو منصة وساطة تقنية تربط المسافرين بوكالات سفر مرخّصة، وهي ليست وكالة سفر ولا تبيع أو تنظّم أو تنفّذ أي خدمة سياحية.
• أي تعاقد أو اتفاق أو دفع يتم بين المسافر والوكالة يكون مباشرًا بينهما وخارج المنصة، وتكون الوكالة وحدها المسؤولة عن تنفيذ خدماتها.
• عروض الأسعار المعروضة في المنصة دعوة للتفاوض ولا تشكل عقدًا؛ ينشأ العقد باتفاق الطرفين المباشر.
• لا تتقاضى المنصة أي مبالغ من المسافرين، ولا تتوسط في الدفع.

3. مسؤولية المسافر

• يقر المسافر بأن جميع البيانات التي يقدمها (الاسم، رقم الجوال، تفاصيل الطلب) صحيحة ودقيقة، ويتحمل وحده مسؤولية أي ضرر ناتج عن بيانات غير صحيحة.
• اختيار الوكالة والتعاقد معها قرار المسافر وعلى مسؤوليته؛ وعلى المسافر التحقق بنفسه من ملاءمة العرض قبل الاتفاق.
• يلتزم المسافر بعدم إساءة استخدام المنصة (طلبات وهمية، انتحال شخصية، محتوى مسيء).

4. مسؤولية الوكالة

• تقر الوكالة بأنها مرخّصة نظاميًا (سجل تجاري + ترخيص سياحي ساري) وأن جميع المستندات والبيانات المقدمة صحيحة، وتتحمل وحدها مسؤولية أي مخالفة.
• الوكالة مسؤولة وحدها عن دقة باقاتها ومقاطعها وعروض أسعارها، وعن تنفيذ ما تتعاقد عليه مع المسافر.
• تلتزم الوكالة بنشر محتوى تملك حقوقه فقط (بدون علامات مائية أو محتوى منسوخ من جهات أخرى).
• يُحظر على الوكالة التواصل المباشر مع المسافر قبل قبوله عرضها أو قبل تقديمه طلبًا مباشرًا لباقتها، ويُحظر تضمين بيانات تواصل داخل عروض الأسعار.
• اشتراك الوكالة يخضع لاتفاقية الاشتراك المبرمة خارج المنصة، وللمنصة إيقاف الحساب عند انتهاء الاشتراك أو مخالفة الشروط.

5. المحتوى والمراجعة

• يخضع كل محتوى تنشره الوكالات (باقات، مقاطع) لمراجعة إدارة المنصة قبل الظهور، وللإدارة رفض أو إزالة أي محتوى دون إبداء أسباب تفصيلية.
• بنشر المحتوى، تمنح الوكالة المنصة ترخيصًا غير حصري لعرضه داخل المنصة ولأغراض الترويج لها.

6. إخلاء المسؤولية وحدودها

• تُقدَّم المنصة «كما هي» دون ضمانات؛ ولا تضمن المنصة استمرارية الخدمة أو خلوها من الأخطاء.
• لا تتحمل المنصة أي مسؤولية عن: جودة الخدمات السياحية أو تنفيذها، الخسائر الناتجة عن التعاقد بين المسافر والوكالة، دقة المحتوى المقدم من الوكالات.
• في جميع الأحوال، تنحصر أي مسؤولية للمنصة — إن وُجدت — في الحدود التي يقررها النظام السعودي.

7. الحسابات والإيقاف

• للمنصة إيقاف أو إنهاء أي حساب يخالف هذه الشروط أو يسيء استخدام المنصة.
• للمستخدم حذف حسابه في أي وقت (انظر سياسة الخصوصية لتفاصيل حذف البيانات).

8. الملكية الفكرية

اسم ترافوجو وشعارها وتصميم المنصة ملك لـ طاقم ترافوجو ولا يجوز استخدامها دون إذن كتابي.

9. التعديلات

للمنصة تعديل هذه الشروط، ويُعد استمرار الاستخدام بعد الإشعار بالتعديل موافقةً عليه.

10. القانون الواجب والاختصاص

تخضع هذه الشروط لأنظمة المملكة العربية السعودية، وتختص محاكم جدة بأي نزاع.

Terms of Service — Travogo (English)

1. Definitions

• Platform: the Travogo app and website (travogo.app), owned by Travogo Team.
• Traveler: any user browsing the Platform or creating an account to request quotes.
• Agency: a licensed travel establishment approved to join the Platform.
• RFQ: a request submitted by a Traveler to receive quotes from Agencies.
• Quote: an offer submitted by an Agency in response to an RFQ.
• Direct Request: a request submitted by a Traveler for a specific package offered by a specific Agency, in which the Traveler explicitly consents to disclosing their contact details to that Agency so it can contact them.

2. Nature of the Platform — Intermediary Only

• Travogo is a technology intermediary connecting Travelers with licensed travel agencies. It is not a travel agency and does not sell, organize, or perform any travel service.
• Any contract, agreement, or payment occurs directly between Traveler and Agency, outside the Platform. The Agency alone is responsible for delivering its services.
• Quotes displayed on the Platform are invitations to negotiate, not contracts; a contract arises only by direct agreement between the parties.
• The Platform charges Travelers nothing and does not intermediate payments.

3. Traveler Responsibility

• The Traveler warrants that all information provided (name, mobile number, request details) is true and accurate, and bears sole responsibility for harm arising from inaccurate information.
• Choosing and contracting with an Agency is the Traveler's own decision and risk; the Traveler must independently verify an offer's suitability before agreeing.
• The Traveler shall not misuse the Platform (fake requests, impersonation, abusive content).

4. Agency Responsibility

• The Agency warrants that it is duly licensed (valid commercial registration + tourism license) and that all submitted documents and data are accurate, bearing sole responsibility for any violation.
• The Agency is solely responsible for the accuracy of its packages, reels, and quotes, and for performing what it contracts with the Traveler.
• The Agency shall publish only content it owns the rights to (no watermarks or content copied from third parties).
• The Agency shall not contact a Traveler directly before its quote is accepted or before the Traveler submits a Direct Request for its package, and shall not embed contact details inside quotes.
• Agency subscriptions are governed by the subscription agreement concluded off-platform; the Platform may suspend accounts upon expiry or breach.

5. Content & Moderation

• All Agency content (packages, reels) is subject to Platform review before appearing; the Platform may reject or remove content at its discretion.
• By publishing, the Agency grants the Platform a non-exclusive license to display the content within the Platform and to promote the Platform.

6. Disclaimers & Limitation of Liability

• The Platform is provided "as is" without warranties; no guarantee of uninterrupted or error-free service.
• The Platform bears no liability for: quality or performance of travel services, losses arising from Traveler–Agency contracts, or the accuracy of Agency-provided content.
• In all cases, any Platform liability — if established — is limited to the extent permitted by Saudi law.

7. Accounts & Suspension

• The Platform may suspend or terminate accounts breaching these Terms or misusing the Platform.
• Users may delete their account at any time (see the Privacy Policy for data-deletion details).

8. Intellectual Property

The Travogo name, logo, and Platform design belong to Travogo Team; use requires written permission.

9. Amendments

The Platform may amend these Terms; continued use after notice constitutes acceptance.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of the Kingdom of Saudi Arabia; the courts of Jeddah have jurisdiction.
